Campbell County Amended Version 2: PROPOSED RESOLUTION FOR STORAGE OF NUCLEAR WASTE

PROPOSED RESOLUTION FOR STORAGE OF NUCLEAR WASTE IN CAMPBELL COUNTY
WHEREAS, given the increasing interest in nuclear energy in Campbell County and throughout
the State of Wyoming, the Board of Commissioners wishes to articulate and convey its position
regarding nuclear waste storage to the public; and
WHEREAS, the Nuclear Waste Policy Act of 1982 assigned the Department of Energy (DOE) to
establish a permanent, deep geologic repository for used nuclear fuel. DOE is actively working
to identify one or more sites for the consolidated interim storage of spent fuel using a consent-
based siting approach until the federal government determines a permanent disposal solution;
and
WHEREAS, the State of Wyoming currently has legislation in effect not to accept nuclear
storage within in state; and
WHEREAS, Wyoming House Bill 131, “Nuclear Power Generation and Storage Amendments,”
was passed in 2022 to facilitate the construction of a nuclear power plant near Kemmerer.
Terra Power, a nuclear reactor company co-founded by Bill Gates, is partnering with power
company Pacific Corp to open a 345-megawatt reactor in 2028. This legislation permits
nuclear power plants operating within the state to store their own radioactive waste
temporarily, but prohibits the import of radioactive waste from nuclear power plants located
outside the state; and
WHEREAS, the Wyoming Joint Minerals, Business & Economic Development Interim
Committee is considering sponsoring the draft bill “Advanced Nuclear Manufacturers-Fuel
Storage” during the 2026 budget session that would allow manufacturers to store spent
nuclear fuel and high-level waste in the state; and
NOW THEREFORE BE IT RESOLVED that the Campbell County Board of Commissioners
recognizes the importance of public input. In the future the Campbell County constituents
may request an opportunity to vote on nuclear waste in Campbell County. The legal process
would be followed.
THEREFORE, BE IT FURTHER RESOLVED that the Campbell County Board of Commissioners
shall adhere to the following guidelines regarding nuclear waste storage in Campbell County
until a public vote is conducted:
o No interim nuclear storage – domestically produced or relocated;
o No consolidate interim storage – domestically produced or relocated;
o No deep geological repository (caverns);
o No deep geological repository (bore hole);
o No exemptions granted for interim or consolidated storage, or geological
repositories.
